General Terms and Conditions for travel seminars

These terms and conditions apply to the travel seminars for which FOTOCAMPUS Claus Brandt, hereafter called “FOTOCAMPUS,” assumes responsibility as tour operator for travel services such as accommodations, transportation, and meals. They do not apply to seminars (workshops, exploratory courses).

1. Registration and signing of contract

All registration for seminars must occur via e-mail or in writing. The registration form is available as a PDF file at: www.FOTOCAMPUS.de. On request, we will send you the registration form. Your registration will be confirmed by us via e-mail or in writing and is only binding with the booking confirmation.

2. Advance payment and payment

Once confirmation has been handed over or sent, advance payment in the amount of 20% of the price of the tour can be demanded. The confirmation is proof that FOTOCAMPUS, in case it is unable to pay or enters bankruptcy, will repay the amounts paid by the traveler and has ensured the traveler’s return trip. The balance of payment is due on handing over or receipt of travel documents, at the latest 30 days before the beginning of the tour, insofar as the tour has not been cancelled by FOTOCAMPUS.

FOTOCAMPUS can change the tour price in case of increases in the expenditures for the services of third parties (e.g. transportation costs, airport fees or changes in the exchange rate). However, this applies only if there are at least 4 months between the tour confirmation and the start of the tour and the traveler was notified of the price increase at least 21 days before the start of the tour.

3. Changes in services

For factually-justifiable reasons, FOTOCAMPUS reserves the right to deviate from details in the brochure before contract signing; the participant will be informed of such changes before booking.

Changes to or deviations of individual travel services from the content of the tour contract that become necessary after contract signing and that were not made by FOTOCAMPUS in breach of good faith are only permitted insofar as these are not significant and they do not endanger the entire layout of the trip.
FOTOCAMPUS is obliged to notify the participant immediately about changes to services. If necessary, FOTOCAMPUS will offer the participant a rebooking free of charge or the opportunity to withdraw free of charge.

In case of non-availability (e.g. airport strike or closing of a national park), FOTOCAMPUS can withdraw the service from the tour contract, but FOTOCAMPUS is obligated to inform the participant immediately about the non-availability and to refund the tour price paid immediately.

4. Cancellation / substitute participants

The participant can withdraw at any time before the beginning of the tour. Authoritative is the receipt of the declaration of withdrawal by FOTOCAMPUS. The withdrawal must be declared in writing.

If the participant withdraws from the tour contract or if the participant does not start the tour, then FOTOCAMPUS can demand repayment for travel arrangements made and for its time and effort. For the calculation of repayment, usually-spared expenditures and usually-possible other usage of the travel services must be taken into account.

FOTOCAMPUS can demand a flat fee repayment in relation to the tour price:

Up to the 90th day before the start of the tour………………10%
Up to the 45th day before the start of the tour………………20 %
Up to the 30th day before the start of the tour………………40 %
Up to the 15th day before the start of the tour………………70 %
As of the 15th day before the start of the tour………………90 %

The participant is permitted to prove to FOTOCAMPUS that actually no costs or lower costs than those claimed as the applicable flat fee were incurred. In this case, the participant is only obligated to pay the costs that were actually incurred.

Up to the start of the tour, the traveler can demand that a third party can enter into the rights and duties arising from the tour contract. FOTOCAMPUS can veto the entry of the third party if this third party does not meet the special tour requirements.
If a third party enters into the contract, then this person and the participant of FOTOCAMPUS are liable as co-debtors for the tour price and the additional costs arising due to the entry of the third party.

5. Cancellation / minimum number of participants

FOTOCAMPUS can terminate the tour contract:
a) Without adherence to a deadline
If the traveler continuously disturbs the execution of the tour despite a warning from FOTOCAMPUS; if the traveler behaves in breach of contract, for example by sexually harassing or insulting fellow travelers, with alcohol-related failures, constant tardiness at departure times or if, despite repeated requests, the traveler does not adhere to FOTOCAMPUS’ arrangements.

b) Up to 2 weeks before the start of the tour
If the minimum number of participants is not reached if in the brochure and on the booking confirmation a minimum number of participants is noted for the corresponding tour. Here FOTOCAMPUS is obliged to notify the participant immediately. The participant will be refunded the tour price immediately.

6. Limitation of liability

The contractual liability of FOTOCAMPUS for damages that are not bodily damages and do not result from injury of sexual self-determination is limited to three times the tour price
a) Insofar as damage to the participant is not caused deliberately not due to gross negligence
b) Insofar as FOTOCAMPUS is responsible for damages to a participant solely due to the fault of a service provider.

For all damage claims against FOTOCAMPUS resulting from illegal behavior that do not rest on premeditation or gross negligence, FOTOCAMPUS is liable for property damages up to EUR 4,100; if this total exceeds three times the tour price, the liability for property damages is limited to the amount of three times the tour price. These liability limits apply both to the traveler and the tour.

A damage claim against FOTOCAMPUS is limited or excluded if, due to international agreements or regulations based on such agreements, the services to be performed by a service provider are applicable, a claim to damages against the service provider can only be made under certain prerequisites or limitations or is excluded under particular prerequisites.

7. Exclusion of claims and statute of limitations

The participant must make claims against FOTOCAMPUS due to performance of the tour not in compliance with the contract within one month after the contractually-provided end of the tour. After expiration of the deadline, the traveler can make claims if, without fault, he or she was prevented from adhering to the deadline.

Claims of the traveler arising from the tour contract such as remedy, reduction, termination due to defect, damages due to violation of the tour contract expire in one year. The statute of limitations begins on the day on which, according to the contract, the tour was supposed to end. If there are negotiations between the traveler and FOTOCAMPUS about the claim or the circumstances underlying the claim, then the statute of limitations is inhibited until the participant or FOTOCAMPUS refuses to continue the negotiations. The statute of limitations begins at the earliest 3 months after the end of the inhibition.

8. Passport, visa, and health regulations

FOTOCAMPUS is responsible for informing citizens of the country in which the tour is offered about provisions of passport, visa, and health regulations as well as their possible change before the start of the tour. For citizens of other countries, the relevant consulate will provide information.

FOTOCAMPUS is not liable for the timely granting and receipt of the necessary visa by the respective diplomatic representative if the traveler has commissioned FOTOCAMPUS to provide it unless FOTOCAMPUS is responsible for the delay.

If the participant is aware of health risks, he or she must inform FOTOCAMPUS at registration. FOTOCAMPUS can demand a doctor’s certificate. It is the obligation of the tour director to decide whether a participant is in a position to start or continue the tour. FOTOCAMPUS assumes no responsibility for medical care.

9. Liability of participants for equipment

Insofar as FOTOCAMPUS makes FOTOCAMPUS’ cameras, lenses, and photo accessories available to participants, the participants are liable for damage to this equipment even in case of slight negligence. Insofar as FOTOCAMPUS’ photographic equipment insurance pays a claim for damages, liability is limited to the portion not paid by the insurance and an additional flat fee for time and effort of EUR 50.
For example, insurance does not pay for soiling, loss, and atmospheric exposure or in case of willful or malicious damage. The participant is permitted to prove to FOTOCAMPUS that actually no costs or lower costs than those claimed as the applicable flat fee were incurred. Changes to or worsening of the object borrowed that occur due to proper use according to the contract are not the fault of the borrower.

10. Copyrights

Working papers are distributed for nearly all seminars. These are copyright protected and may not – not even in extract – be duplicated without the permission of FOTOCAMPUS.

11. Privacy

Registration and address data is stored by FOTOCAMPUS in order to perform FOTOCAMPUS’ services and in order to advertise FOTOCAMPUS’ services. FOTOCAMPUS is obligated not to release personal data to third parties. Participants are entitled to revoke permission for use of their data at any time.
